You may not exploit the Products and Services to access unauthorized information. BBurger reserves the right to modify, suspend, or discontinue the Products and Services for any reason, with or without notice. Payment and Fees

If you are billed for the Products and Services by one of our partners, its billing terms shall apply. To access any of our Products and Services, you must have access to the Internet and must create an account, either on a free or paid-subscription basis. To use our paid Products and Services, you must have a current valid accepted payment method as indicated during sign-up ("Payment Method"). A valid credit card is required for paid subscription Products and Services. When you subscribe to paid Products and Services, your credit card account will be billed according to current BBurger rates using *Stripe for the selected subscription plan to prepay usage of Product and Services for the current period. For monthly plans you will be charged subsequently on the same day of each month. If the billing date is the 29th - 31st, and the billing month does not contain this date, then the billing date will be adjusted to the last day of the current calendar month. Annual plan renewals will be charged on same day of the following year to prepay usage of Product and Services for the next annual service period. If you choose to upgrade or downgrade your subscription from one paid plan ("Current Plan") to another paid plan ("New Plan"), your service will be switched immediately to the New Plan. The payment for the unused portion of service from your Old Plan will be credited toward the price of the New Plan. Your future monthly billing date will always remain the same. If the Plan change is a downgrade, credit will be applied to future months and your next monthly fee will be charged when the credit from the Old Plan has been used. If the Plan change is an upgrade, you will be charged the remaining portion for the current billing period immediately, and subsequent months will be charged on your previously existing billing date. Remaining credit from the current billing period will be calculated based on the number of remaining days in the current billing month. You may terminate your account by selecting "Close my account" option in your account. You need to cancel your paid subscription before you can close your account.

Features and Functionality

The Products and Services include an online shopping cart that can be integrated with your existing website, blog, social network as applicable. We reserve the right in our sole and absolute discretion to make changes from time to time and without notice in how we operate the Products and Services. Any description of how the Products and Services work should not be considered a representation or obligation with respect to how the Products and Services always will work. We are making constant adjustments to the Products and Services and often these Terms of Service do not capture these adjustments completely.

For members in certain countries, some of the Products and Services, such as our online shopping cart, can be added to your page on social media networks, such as Facebook. BY CONNECTING YOUR BBurger.COM ACCOUNT TO YOUR FACEBOOK ACCOUNT, YOU ACKNOWLEDGE AND AGREE THAT YOU ARE CONSENTING TO THE CONTINUOUS RELEASE OF INFORMATION ABOUT YOU TO OTHERS, INCLUDING TO FACEBOOK (IN ACCORDANCE WITH YOUR PRIVACY SETTINGS ON FACEBOOK AND YOUR ACCOUNT SETTINGS ON BBurger.COM). IF YOU DO NOT WANT INFORMATION ABOUT YOU TO BE SHARED IN THIS MANNER, DO NOT USE THE FACEBOOK SHARE FEATURE. We and Facebook are continually making changes and improvements to this feature, and therefore the available features and information that is shared may change from time to time. These changes may take place without notice to you and may not be described in these Terms of Service.

Identity Protection

You are responsible for updating and maintaining the truth and accuracy of the information you provide to us relating to your account. Limitation of Liability and Damages

Governing Law

Arbitration Agreement

You and BBurger agree that any dispute, claim or controversy arising out of or relating in any way to the Products and Services, including our website, user interfaces, these Terms of Service and this Arbitration Agreement, shall be determined by binding arbitration in England the process offered by English courts and the Arbitration Act 1996. of general jurisdiction. YOU AND BBurger AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY IN YOUR OR ITS INDIVIDUAL CAPACITY, AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS OR REPRESENTATIVE PROCEEDING. Further, unless both you and BBurger agree otherwise, the arbitrator may not consolidate more than one person claims with your claims, and may not otherwise preside over any form of a representative or class proceeding. If this specific provision is found to be unenforceable, then the entirety of this arbitration provision shall be null and void. The arbitrator may award declaratory or injunctive relief only in favor of the individual party seeking relief and only to the extent necessary to provide relief warranted by that party individual claim

RETURNS POLICY
Overview
BBurger policy covers 30 days. If 30 days have gone by since your purchase, then unfortunately no refund or exchange can be given
For your order/items to be eligible for a return, your item must be unused and in the same condition that you received it. It must also be in the original packaging to BBurger
Orders refunds will be calculated differently depending on their status in the Workflow:
1. Unshipped ("Cost of Items" + "Shipping Charge" will be refunded)

2. Accepted
3. Rejected

2. Delivered
3. Collected
4. Canceled

Any handling fee taken by payment providers cannot be refunded, and any shipping costs already incurred cannot be refunded.
Exemptions
Goods that are exempt from being returned may include but not limited to the following types:
Perishable goods such as food, flowers,
Newspapers or magazines
Sanitary goods, or underwear
Hazardous materials, or flammable liquids or gases.
Gift cards or vouchers

To action your return, we require a receipt or proof of purchase, we can only refund money to the card it was paid from

There are certain situations where only partial refunds are granted: (if applicable)
* Book with obvious signs of use
* CD, DVD, VHS tape, software, video game, cassette tape, or vinyl record that has been opened.
* Any item not in its original condition, is damaged or missing parts for reasons not due to our error.
* Any item that is returned more than 30 days after delivery
Refunds (if applicable)
Once your return is received and inspected, BBurger will send you an notification or email to notify you that we have received your returned item. We will also notify you of the approval or rejection of your refund.
If you are approved, then your refund will be processed, and a credit will automatically be applied to your credit card or original method of payment, within a 7 to 10 days.

Late or missing refunds (if applicable)
If you have not received a refund yet, first check your bank account again.
Then contact your credit card company, it may take some time before your refund is officially posted.
Next contact your bank. There is often some processing time before a refund is posted.

Gifts
If the item was marked as a gift when purchased and shipped directly to you, you will receive a gift credit for the value of your return. Once the returned item is received, a gift certificate will be mailed to you.

If the item wasn not marked as a gift when purchased, or the gift giver had the order shipped to themselves to give to you later, we will send a refund to the gift giver and he will find out about your return.

You will be responsible for paying for your own shipping costs for returning your item. Shipping costs are non-refundable. If you receive a refund, the cost of return shipping will be deducted from your refund.
